Terms of Service

Briifd is a product and service offered by DotOneSix LLC ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of Briifd's website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our services, you agree to these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Service

Briifd provides PR coverage analysis and reporting tools. Our service allows you to organize media coverage, analyze sentiment, and generate reports for your clients.

3. Role Definition and No-Publisher Disclaimer

Briifd is a data aggregation, analysis, and automation platform. We are not a publisher or producer of third-party content. Our role is limited to processing and displaying data provided by the user or obtained from third-party sources on the user's behalf. We do not control, endorse, or assume responsibility for any content processed through our platform. Users are solely responsible for ensuring they have all necessary rights to collect, use, and share such content.

4. Eligibility

You must be at least 18 years of age to use our services. By using Briifd, you affirm that you meet this requirement.

5. Account Registration

To use our services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Share your account credentials with unauthorized users
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Reverse engineer or attempt to extract source code
• Upload or add content you do not have the right to use
• Use the service to systematically infringe intellectual property rights

7. Payment Terms

Paid plans are billed monthly or annually as selected. Payments are non-refundable except as required by law. We may change our prices with 30 days notice.

8. Free Trial

We offer a 7-day free trial for new users. No credit card is required for the trial. At the end of the trial, you may choose to subscribe to a paid plan or your account will be limited.

9. Data Ownership

You retain all rights to the data you upload to our service. We do not claim ownership of your content. You grant us a limited license to use your data solely to provide the service to you.

10. User Content & Third-Party Content

You may add content to Briifd through various means including RSS feeds, manual entry, URL imports, and email forwarding. You are solely responsible for ensuring you have the right to use any content you add to Briifd.

Third-party content (such as news articles) remains the property of the original publishers. Briifd does not claim ownership of third-party content and provides tools for your organization and reference purposes. Links to original sources are provided for attribution.

When you add RSS feeds or import content from external sources, you represent that: (a) you have the right to access and use that content for your purposes; (b) you will comply with the terms of service of the original content sources; and (c) you understand that Briifd is a tool to help organize content, not a substitute for proper content licensing where required.

11. Automated Content Collection

Briifd respects the rights of content publishers and will honor requests from publishers not to have their websites accessed through automated means for the purpose of retrieving protected content. This limitation does not restrict Briifd from processing or displaying publicly available information about such content obtained from lawful third-party sources.

All responsibility for obtaining and maintaining the legal rights to collect, use, or share any content rests solely with the user. Briifd does not review, verify, or police user-submitted content for compliance with any laws or rights. Our role is limited to providing the technical means to collect, process, and display data at the direction of the user.

Where Briifd facilitates the automated collection of publicly available information at the direction of the user, it does so solely as a technical service. Briifd does not store or republish content except as necessary to provide the service, and only to the extent permitted by applicable law and publisher restrictions.

12. Copyright Policy (DMCA)

Briifd respects the intellectual property rights of others. If you believe content on our service infringes your copyright, please send a notice to our designated DMCA agent:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the material claimed to be infringing and its location on our service; (3) your contact information; (4) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; (5) a statement under penalty of perjury that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (6) your physical or electronic signature.

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content and notify the user who added it. Users may submit a counter-notification if they believe the content was removed in error.

13. Repeat Infringer Policy

Briifd maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. Users who repeatedly upload infringing content or receive multiple valid DMCA notices may have their accounts suspended or terminated at our discretion.

14. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects service availability.

15. Limitation of Liability

To the maximum extent permitted by law, Briifd and DotOneSix LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Briifd and DotOneSix LLC disclaim all liability related to the legality, accuracy, or appropriateness of any third-party content processed through our platform. Your sole remedy for dissatisfaction with the service is to stop using it.

16. Indemnification

You agree to indemnify and hold harmless DotOneSix LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of Briifd, your violation of these Terms, or your violation of any rights of a third party.

17. Termination

We may suspend or terminate your access to Briifd for any violation of these Terms or at our discretion. Upon termination, your right to use the service will immediately cease. You may export your data before termination.

18. Dispute Resolution

Any disputes related to these Terms or Briifd services will be resolved through binding arbitration in the state of Michigan, USA. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

19. Governing Law

These Terms are governed by the laws of the state of Michigan, USA, without regard to conflict of law principles.

20. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the modified Terms.
